Novacorr Healthcare – Terms & Conditions
1. Acceptance of Terms
These Terms & Conditions (“Terms”) apply to all interactions with Novacorr Healthcare, including but not limited to the use of our website, purchase of products, custom orders, and engagement with our staff. By using our website or placing an order, you confirm that you have read, understood, and agreed to be bound by these Terms.
Novacorr reserves the right to amend or update these Terms at any time. Updates will take effect once published on our website. Your continued use of our services constitutes acceptance of the revised Terms.
2. Governing Law
These Terms are governed by the laws of Queensland, Australia. You agree to submit to the jurisdiction of the courts of Queensland for any disputes arising under or in connection with these Terms.
3. Accuracy of Information
Novacorr Healthcare makes every effort to ensure that product descriptions, technical specifications, pricing, and other information displayed on our website or provided by our staff are accurate.
- However, minor discrepancies, typographical errors, and technical variations may occur.
- All information provided is subject to change without notice.
- Any advice, whether written or verbal, is general in nature and should not be relied upon as medical or clinical advice. Customers must seek independent professional or clinical guidance to ensure that our products meet their specific health or therapeutic needs.
4. Intellectual Property
All intellectual property rights, including but not limited to product designs, images, drawings, videos, logos, and written content, remain the property of Novacorr Healthcare.
- No part of this website or our promotional material may be copied, reproduced, distributed, or used for commercial purposes without our prior written consent.
- Customers may not claim ownership or design rights over custom-made products designed or manufactured by Novacorr, regardless of whether customer specifications were provided.
5. User Submissions & Contributions
If you provide Novacorr with content such as specifications, designs, testimonials, or promotional materials:
- You warrant that the material is either your own or that you have lawful permission to provide it.
- You grant Novacorr a royalty-free, perpetual, worldwide licence to use, modify, reproduce, and distribute the material in any format.
- You warrant that the material is accurate, lawful, and does not infringe the rights of third parties.
- Novacorr reserves the right to review, edit, or remove any content submitted by users without notice.
6. Liability Disclaimer
Your use of Novacorr products, services, and website is entirely at your own risk. To the fullest extent permitted by law:
- Novacorr disclaims all liability for loss, damage, injury, or interruption caused directly or indirectly by the use of our website or products.
- Novacorr is not liable for third-party services such as freight, installation contractors, or payment providers.
- Where liability cannot be excluded under law, it will be limited to the replacement, repair, or re-supply of goods, or the value of equivalent services.
7. Registration, Accounts & Security
For customers who create an account with Novacorr:
- You are responsible for maintaining the confidentiality of your login details.
- Novacorr will never request your password by email or through an external website.
- You must notify us immediately of any unauthorised use of your account.
- Accounts may be closed at any time by either party. Obligations under these Terms survive closure.
8. Indemnity
You agree to indemnify and hold harmless Novacorr Healthcare, its employees, agents, and affiliates from any and all claims, losses, damages, costs, and expenses (including legal fees) arising from your breach of these Terms, unlawful use of our products, or negligent conduct.
9. Manufacturing Tolerances
Novacorr Healthcare manufactures high-quality products using Australian steel, foams, and premium fabrics. Each item is handcrafted or custom-built, and while we strive for exact precision, some variations naturally occur during the production process. Unless otherwise agreed in writing, the following tolerances apply:
- Frame dimensions (steel/structural work): ± 10mm (1cm)
- Foam thickness and density: ± 5%
- Upholstery (fabric/vinyl stretch and seam allowance): ± 10mm
- Angles of recline, tilt, or backrest adjustment: ± 2–3°
- Overall assembled product dimensions (width, depth, height): ± 15mm (1.5cm)
These tolerances are consistent with industry best practice and international healthcare furniture manufacturing standards. Variations within these limits are not considered faults or defects and do not give rise to warranty claims or refunds.
10. Custom-Made Products
The majority of Novacorr products are custom-made to suit the individual requirements of our customers. By placing an order, you acknowledge and agree that:
- Custom-made items are non-refundable, non-returnable, and non-cancellable once production has commenced.
- Australian Consumer Law does not provide refunds or exchanges for change of mind or incorrect specifications on custom goods.
- Customers must ensure all measurements, specifications, and requirements are provided accurately at the time of order.
- Novacorr is not responsible for errors caused by incorrect or incomplete information provided by the customer.
- Refunds or remedies will only be available where a product is deemed faulty under the definitions provided by the ACCC.
Important Note: Many Novacorr products are designed for medical and rehabilitative purposes. Incorrect measurements may compromise safety and functionality. Customers are strongly encouraged to consult with an Occupational Therapist or qualified healthcare professional when ordering customised equipment.
11. Shipping & Delivery
- Products are shipped using Novacorr Direct delivery services or reputable freight partners.
- Shipping costs are calculated based on the destination and confirmed at the time of order.
- Estimated delivery dates are provided as a guide only. Novacorr cannot guarantee delivery times and accepts no liability for delays caused by freight providers, customs, or other external factors.
- Risk of loss or damage transfers to the customer upon delivery to the nominated address or upon collection.
- Customers are responsible for ensuring access to the delivery site. Additional fees may apply for redelivery or failed attempts caused by restricted access.
12. Payments & Fees
- Full payment must be received before products are dispatched, unless otherwise agreed in writing.
- Credit card payments incur a surcharge of 2%.
- Late payments are subject to a 3% monthly fee, compounding every 30 days, until the balance is cleared.
- Orders cancelled after acceptance but before production may be subject to a 20% cancellation and restocking fee. Orders cancelled after production commences are non-refundable.
13. Customer Conduct
Novacorr Healthcare enforces a zero-tolerance policy towards abusive or aggressive behaviour directed at staff.
- Abusive, threatening, or aggressive behaviour will result in immediate refusal of service.
- Novacorr reserves the right to cease communication and terminate agreements in the event of such behaviour.
- Where serious threats are made, Novacorr may escalate the matter to police or legal authorities.
14. Feedback & Complaints
We value constructive feedback and aim to resolve all concerns in a professional manner.
- If you have a complaint, please contact us in writing through the “Contact Us” page or via your registered email.
- Complaints will be acknowledged within a reasonable timeframe and investigated promptly.
- Customers are expected to engage respectfully throughout the complaints process.
15. Miscellaneous
- These Terms represent the entire agreement between Novacorr Healthcare and the customer.
- If any provision is found to be invalid or unenforceable, it will be severed without affecting the remainder of the Terms.
- Failure by Novacorr to enforce any right under these Terms does not constitute a waiver of that right.
- Communications sent via email are deemed received within 24 hours; postal notices are deemed received within 3 days (or 7 days for international mail).
